The Licensing Officer introduced the report which set out an application for a new premises licence under section 17 of the Licensing Act 2003 for Old House Hotel, Wickham Square, Wickham, Fareham, PO17 5JG. The application described the premises as a Hotel/Restaurant and Retail Shop located in an area of similar operations within Wickham Village to sell produce to the general public, including alcohol to be sold for consumption on and off the premises in relation to hotel usage, dining, wine tastings, tours tasting events and tourism. Produce would include hot and cold food and beverages both within the premises and on its own land with no alcohol off the premises other than in a sealed container for the consumption by the purchaser at home. The application proposed the supply of alcohol for consumption on and off the premises and late night refreshment as the licensable activities; details of the proposed days and times were outlined in Section 5 of the report. The full application was set out in Appendix 1 to the report.
The Sub-Committee were advised that no representations had been received by any Responsible Authorities. One written representation had been received from ‘Other Persons’ against the application. However, they did not wish to address the Sub-Committee at the meeting. This representation was set out in full in Appendix 2 and related to the prevention of public nuisance licensing objective.
In conclusion, the Licensing Officer advised the Sub-Committee that, if minded to grant the application, there were conditions to consider, as set out in Section 5 of the report, which the Sub-Committee could consider and amend as appropriate to promote the licensing objectives.
At the invitation of the Chairperson, John Wallsgrove, John Gaunt and Partner on behalf of the applicant, addressed the Sub-Committee to set out the application. He responded to questions thereon.
The Sub-Committee retired to deliberate in private.
In his closing statement, the Chairperson stated that the Sub-Committee had carefully considered the application, and the Applicant’s evidence given at the meeting. It had taken into account the Council’s Statement of Licensing Policy, the Public Sector Equality Duty, the Home Office Guidance issued under section 182 of the Licensing Act 2003, the duties under the Crime and Disorder Act 1998, and the rights set out in the Human Rights Act 1998.
RESOLVED:
That the premises licence be granted, as set out in the report, for the following reasons:
REASONS The Sub-Committee considered that the operating schedule, arising from the licence application sufficiently promotes the licensing objective of the prevention of public nuisance. The Sub-Committee noted that no credible risk of public nuisance had been presented at the meeting. Therefore, no conditions needed to be applied.
