The Licensing Manager introduced the report to the Committee. She advised that the Council as the Licensing Authority was required to review and publish its Licensing Policy every five years. The next review was due for adoption in January 2019. The Licensing Manager drew Members' attention to the minor changes to the existing Policy as set out in paragraph 11.6 of the report and to the consultation timetable as set out in paragraph 11.7 of the report.

 

In response to Members’ questions, officers provided the following responses:

 

  • The list of consultees shown in paragraph 11.7 of the report would be reviewed to reflect any organisational name changes.

 

  • The dates shown on page 68 of the agenda pack (or page 55 of Appendix 1) would be revised before adoption.

 

  • The Licensing Manager would approach Housing Services to request details of the “bodies representing residents in the council area”.

 

  • The consultation timetable does meet the minimum required period and enables a decision at the February 2019 Council meeting.

 

  • Appendix C, the Licensing Manager advised that the references in this section would be reviewed as part of the consultation exercise and where necessary, updated before consultation.

 

  • References to race equality within the document would be reviewed to ensure all protected characteristic groups were encompassed.

 

  • With regard to paragraph 2.43 of the Policy, it was agreed to remove the reference to a fee being charged for this service.

 

  • Following discussion, it was agreed that references to “Male and Female Toilet” provision would be amended to “Toilet” provision. 

 

In relation to paragraph 2.20 of the Policy, the Committee discussed the issue of “Drinking on the Streets”. The Licensing Manager stated that the Neighbourhood Services and Licensing teams along with the Police and other partners worked together with Licence holders on this issue. Several premises had been identified as having specific issues and these were being dealt with by officers and the Police. Further comments were made concerning Abbey Gardens. The Licensing Manager advised that members may want to obtain an update regarding the Winchester BiD ranger programme and that all concerns of anti-social behaviour should be fed into the Community Safety team.

   

RESOLVED:

 

1.    That the reviewed Draft Licensing Policy at Appendix 1, including any amendments by the Licensing and Regulation Committee, be approved for consultation as detailed in paragraphs 11.7 to 11.10 of the report.

 

2.    That following the consultation period, should no comments be received, that the Draft Licensing Policy as sent out for consultation be recommended for adoption at the next available Council meeting.

The Licensing Manager introduced the report and advised the Committee that the Council as the Licensing Authority was required to review and publish its Statement of Principles under the Gambling Act 2005 every three years. The next review was due for adoption in January 2019.

 

The Committee's attention was drawn to the proposed minor amendments to the Statement of Principles as detailed in paragraph 11.6 of the report and to the proposed consultation plan as documented in paragraph 11.7 of the report. Members asked several questions and debated the report in detail.

 

Members discussed current issues that were being debated nationally regarding gambling related issues, in particular internet gambling and fixed-odds betting machines. The Licensing Manager advised that gambling regulation was an ongoing process but as national policy changes, those changes would be reflected in local practices.

 

Members also discussed issues connected with preventing gambling by children, including signage and test purchases. The Licensing Manager confirmed that the primary responsibility to prevent this activity rests with the establishment concerned. However, where appropriate, enforcement action would take place in line with the Council’s policy and in partnership with the Police and/or Gambling Commission.

 

Following discussion, it was noted that references were made to various categories of gaming machines, but that the definitions shown on page 112 of the Report were to be deleted.

  

RESOLVED:

           

1.    That the reviewed Draft Statement of Principles at Appendix 1, including any amendments by the Licensing and Regulation Committee, be approved for consultation as detailed in paragraphs 11.7 to 11.10 of the report.

 

2.    That following the consultation period, should no comments be received, that the Draft Statement of Principles as sent out for consultation be recommended for adoption at the next available Council meeting
